OFFICIAL RULES AND TERMS & CONDITIONS

Four-Night All-Inclusive Vacation Giveaway

NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN. A PURCHASE, PAYMENT, DONATION, SUBSCRIPTION, OR OTHER TRANSACTION WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.

By entering this giveaway, each entrant agrees to be bound by these Official Rules and Terms & Conditions.

1. SPONSOR

The Four-Night All-Inclusive Vacation Giveaway ("Giveaway") is sponsored solely by DBV Enterprises, LLC ("Sponsor").

This Giveaway is independently offered by Sponsor. The resort, hotel, vacation provider, certificate issuer, auction organizer, website hosting provider, and any social media platform on which the Giveaway may be mentioned or promoted are not sponsors or administrators of this Giveaway unless expressly stated otherwise.

The vacation certificate being awarded was previously purchased by Sponsor at an auction and is being given away without compensation or consideration from entrants.

2. NO PURCHASE NECESSARY

No purchase, payment, donation, subscription, membership, or other financial consideration is necessary to enter or win.

Making a purchase from Sponsor, visiting Sponsor's business, following Sponsor on social media, purchasing merchandise, subscribing to a paid service, or otherwise providing anything of monetary value will not increase an entrant's chances of winning.

Entry is completely free.

3. ELIGIBILITY

The Giveaway is open to legal residents of the fifty (50) United States and District of Columbia who are at least twenty-one (21) years of age at the time of entry.

Employees, contractors, agents, and immediate family or household members of Sponsor who are directly involved in administering or selecting the winner of the Giveaway are not eligible to enter.

Entrants must possess any identification, passport, visa, travel authorization, or other documentation necessary to utilize the prize.

The Giveaway is void where prohibited or restricted by applicable law.

4. GIVEAWAY PERIOD

The Giveaway begins at August 26th, 2026 6:00 PM Central Time and ends at 11:59 p.m. Central Time on November 14, 2026 ("Entry Period").

Entries received before or after the Entry Period are not eligible.

5. HOW TO ENTER

Eligible individuals may enter by completing and submitting the official Giveaway entry form located on Sponsor's website during the Entry Period.

Limit one (1) entry per person unless Sponsor expressly states otherwise on the Giveaway entry page.

Automated entries, entries generated by scripts or bots, fraudulent entries, duplicate entries, entries submitted using false identities, or entries that otherwise attempt to circumvent these Official Rules may be disqualified.

No purchase or payment is required to submit an entry.

6. PRIZE

One (1) eligible entrant will receive a certificate or voucher for a four-night all-inclusive vacation ("Prize").

The Prize includes only those accommodations, meals, beverages, amenities, services, and other benefits specifically provided by the vacation certificate or voucher and its issuing provider.

AIRFARE IS NOT INCLUDED.

Unless expressly included by the vacation provider, the winner is responsible for transportation to and from the destination, transportation to and from airports, passports, visas, travel documents, travel insurance, baggage charges, personal purchases, gratuities not included by the provider, excursions not included by the provider, and any other expenses not expressly covered by the vacation certificate.

The Prize has an approximate retail value ("ARV") of $2000.

No cash equivalent or cash substitution will be provided by Sponsor.

The Prize is being transferred to the winner as-is and as originally provided to Sponsor, subject to all terms, restrictions, reservation requirements, availability requirements, blackout dates, occupancy restrictions, and other conditions imposed by the vacation provider or certificate issuer.

7. EXPIRATION AND REQUIRED TRAVEL

The vacation certificate expires June 23, 2027.

The winner is solely responsible for making reservations sufficiently in advance to utilize the Prize before its expiration.

Unless the certificate or vacation provider expressly states otherwise, the winner should assume that travel must be completed before June 23, 2027.

Sponsor strongly recommends that the winner contact the vacation provider immediately after receiving the Prize to determine available travel dates and reservation requirements.

Sponsor has no ability or obligation to extend the certificate's expiration date.

Failure of the winner to reserve or complete travel within the required period will result in forfeiture of any unused portion of the Prize, and Sponsor will have no obligation to provide a replacement, cash payment, refund, alternate vacation, or other compensation.

8. WINNER SELECTION

One potential winner will be selected by random drawing from all eligible entries received during the Entry Period.

The random drawing will occur on or about November 15, 2026.

The odds of winning depend entirely upon the total number of eligible entries received.

The potential winner will be contacted using the email address, telephone number, or other contact information submitted with the winning entry.

9. WINNER NOTIFICATION AND ACCEPTANCE

The potential winner must respond to Sponsor's notification within five (5) calendar days after the notification is sent.

Sponsor may require the potential winner to provide reasonable proof of identity, age, residence, eligibility, and any information reasonably required for tax-reporting purposes.

The potential winner may also be required to sign an eligibility affidavit, prize acceptance form, liability release, and/or other documentation reasonably necessary to transfer the vacation certificate.

If a potential winner:

  • cannot be contacted;

  • fails to respond within the required period;

  • is determined to be ineligible;

  • declines the Prize;

  • provides false or inaccurate information; or

  • fails to complete reasonably required prize-transfer documentation,

the potential winner may be disqualified and Sponsor may select an alternate winner by random drawing.

10. TAXES

The winner is solely responsible for all federal, state, local, or other taxes resulting from acceptance or use of the Prize.

The fair market value of prizes and awards may constitute taxable income to the recipient under federal law.

If required by law, Sponsor may require the winner to complete IRS Form W-9 or other appropriate tax documentation and may issue an IRS Form 1099-MISC or other applicable tax form reporting the value of the Prize.

Sponsor does not provide tax advice, and the winner should consult an independent tax professional regarding the tax consequences of accepting the Prize.

11. VACATION PROVIDER; NO GUARANTEE BY SPONSOR

Sponsor did not create, manufacture, operate, manage, or provide the vacation being awarded.

Sponsor purchased the vacation certificate at an auction and is transferring the benefit of that certificate to the Giveaway winner.

Sponsor is not a travel agency, tour operator, airline, hotel, resort, transportation provider, excursion provider, insurance company, or vacation provider.

Sponsor makes no representation, guarantee, or warranty concerning:

  • availability of particular travel dates;

  • room type or accommodations;

  • quality of accommodations, food, beverages, services, or amenities;

  • transportation;

  • weather;

  • security or safety at the destination;

  • actions or omissions of the vacation provider;

  • changes to resort operations;

  • cancellations or closures;

  • government travel restrictions;

  • strikes;

  • natural disasters;

  • illness or disease;

  • acts of God;

  • acts of third parties;

  • or any other matter outside Sponsor's reasonable control.

Any dispute concerning the accommodations, services, reservations, certificate restrictions, or actual vacation experience must be addressed directly with the applicable vacation provider.

12. ASSUMPTION OF RISK

Travel involves inherent risks.

By accepting and using the Prize, the winner voluntarily assumes all risks associated with the trip and travel, including but not limited to risks involving transportation, recreational activities, food or beverage consumption, illness, accident, injury, property loss, theft, delays, cancellations, severe weather, international or domestic travel, and the actions or omissions of third-party service providers.

The winner is responsible for determining whether travel is appropriate for the winner and any traveling companion.

13. RELEASE AND LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, by entering the Giveaway and/or accepting the Prize, each entrant and winner releases and agrees to hold harmless Sponsor and Sponsor's owners, members, officers, employees, contractors, representatives, affiliates, successors, and assigns from claims, demands, damages, losses, liabilities, costs, or causes of action arising from or relating to:

  1. participation in the Giveaway;

  2. acceptance, possession, use, misuse, or inability to use the Prize;

  3. travel undertaken in connection with the Prize;

  4. acts or omissions of the resort, hotel, airline, transportation provider, vacation provider, certificate issuer, or any other third party;

  5. bodily injury, illness, death, or property damage occurring during or in connection with the trip;

  6. delayed, cancelled, unavailable, changed, or interrupted travel;

  7. loss, theft, destruction, expiration, or non-use of the Prize after it has been transferred to the winner; or

  8. any condition, defect, representation, or warranty associated with the vacation or vacation provider.

Sponsor's responsibility is limited to making a good-faith random selection of an eligible winner and transferring the valid vacation certificate or voucher to that winner.

Nothing in these Official Rules is intended to waive or limit liability that cannot legally be waived or limited under applicable law.

14. PRIZE PROVIDED "AS IS"

THE PRIZE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY BY SPONSOR OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR PARTICULAR TRAVEL EXPERIENCE, TO THE EXTENT SUCH WARRANTIES MAY LEGALLY BE DISCLAIMED.

Sponsor has not received compensation from the vacation provider for conducting this Giveaway and does not represent that the vacation provider sponsors, endorses, or is affiliated with this Giveaway.

15. TRAVELING COMPANIONS

Any person accompanying the winner travels at that person's own risk and is subject to all rules, eligibility requirements, occupancy restrictions, identification requirements, and other conditions established by the vacation provider.

Sponsor assumes no responsibility or liability for any traveling companion.

The winner is solely responsible for determining who, if anyone, will accompany the winner and for ensuring that all travelers possess appropriate documentation and satisfy the provider's requirements.

16. CHANGES OR CANCELLATION BY VACATION PROVIDER

Sponsor is not responsible if the vacation provider modifies, limits, cancels, suspends, discontinues, becomes insolvent, closes, or otherwise fails to honor some or all of the vacation certificate after Sponsor has transferred the certificate to the winner.

Sponsor will reasonably cooperate in providing proof of Sponsor's original acquisition of the certificate if necessary, but Sponsor will not be required to purchase a substitute vacation or reimburse the winner for the value of a vacation that a third-party provider fails to furnish.

17. GIVEAWAY INTEGRITY

Sponsor reserves the right to disqualify any individual Sponsor reasonably believes has attempted to manipulate, interfere with, disrupt, or compromise the fair administration of the Giveaway.

If technical failures, fraud, unauthorized intervention, legal restrictions, events beyond Sponsor's reasonable control, or other circumstances materially impair the integrity or lawful operation of the Giveaway, Sponsor may suspend, modify, or terminate the Giveaway to the extent permitted by applicable law.

If the Giveaway is terminated after eligible entries have been received, Sponsor may select a winner from eligible entries received before termination if doing so is lawful and reasonably practicable.

18. WEBSITE AND TECHNOLOGY

Sponsor is not responsible for lost, late, incomplete, corrupted, misdirected, or undelivered entries resulting from internet outages, website failures, server errors, software errors, telecommunications failures, browser incompatibilities, or other technical problems outside Sponsor's reasonable control.

Proof that an entrant attempted to submit an entry does not constitute proof that Sponsor received the entry.

19. PRIVACY

Personal information submitted through the Giveaway entry form will be used for administering the Giveaway, verifying eligibility, contacting the potential winner, complying with legal obligations, and transferring the Prize.

Entering the Giveaway does not, by itself, constitute consent to receive marketing communications unless the entrant separately and affirmatively opts in to receive such communications.

Sponsor will not sell entrants' Giveaway information solely because they entered the Giveaway.

20. PUBLIC ANNOUNCEMENT OF WINNER

By accepting the Prize, the winner agrees that Sponsor may publicly identify the winner by first name, last initial, city, and state for purposes of announcing and verifying the outcome of the Giveaway, except where prohibited by law.

Any additional use of the winner's image, likeness, testimonial, photograph, voice, or other personal attributes for advertising or promotional purposes will require any consent required by applicable law.

21. SOCIAL MEDIA DISCLAIMER

If this Giveaway is promoted on Facebook, Instagram, TikTok, YouTube, X, Twitch, or any other social media platform, the Giveaway is not sponsored, endorsed, administered by, or associated with those platforms unless expressly stated otherwise.

By entering, entrants acknowledge that they are providing their information to Sponsor and not to the applicable social media platform.

22. GOVERNING LAW

Except where prohibited by applicable law, these Official Rules and any dispute arising from the Giveaway shall be governed by the laws of the State of Arkansas, without regard to conflict-of-law principles.

Any provision of these Official Rules determined to be unlawful or unenforceable shall be severed or limited to the minimum extent necessary, and the remaining provisions shall remain in effect.

23. WINNER'S LIST

After the winner has been confirmed, Sponsor may publish the winner's first name, last initial, city, and state on Sponsor's website or social media accounts.

A winner's name may also be provided when required by applicable law.

24. AGREEMENT TO OFFICIAL RULES

Submission of an entry constitutes the entrant's acknowledgment that the entrant has read, understands, and agrees to these Official Rules and Terms & Conditions.

NO PURCHASE NECESSARY. VOID WHERE PROHIBITED. ODDS OF WINNING DEPEND ON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED. AIRFARE IS NOT INCLUDED. THE VACATION CERTIFICATE EXPIRES JUNE 23, 2027.
